Section 7(2.1) of the Family Property Act states the relevant date for the valuation of property is the date of trial. In making a distribution of property, the Court may consider, under section 8(f), whether the property was acquired when the spouses were living separately and apart. This refresher discusses the case law and the practical conversations you should be discussing with your client.
